THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER WRIT APPEAL NO.270 OF 2015 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} Pursuant to the interim order passed by this Court on 15.12.2016, the matter was referred to the High Court Lok Adalat. Sri V.Narasimha Goud, learned counsel for the respondentworkman, would submit that an award was passed by the High Court Lok Adalat on 29.12.2016 recording the agreement of the appellant to reinstate the respondent-writ petitioner with continuity of service, duly imposing punishment of deferment of annual increment for one year with cumulative effect; the period from the date of removal till the date of reporting for duty was to be treated as continuity of service only for pay protection and for the purpose of terminal benefits; and that the workman would not be entitled for any attendant benefits for the period which he was out of service.
As the matter has already been settled by the High Court Lok Adalat, this Writ Appeal is disposed of in terms of the award of the Lok Adalat dated 29.12.2016. There shall be no order as to costs.
