THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6794 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A70 in Crime No.227 of 2022 on the file of RPS, Secunderabad registered for the offences punishable under Sections 134, 1347, 324, 307, 435, 427, 448, 336, 332, 341, 120(B) and 201 read with Section 149 of Indian Penal Code and Sections 150, 151, 152 of Indian Railway Act and Section 3 of PDPP Act and Section 174 of Cr.P.C. 2.

The facts of the case are that the petitioner and others are alleged to be a part of mob which set fire to railway coaches and broke glasses in the railway station, that being part of an agitation carried out by several hundreds of students. 3.

Heard learned counsel for the petitioner/A70 who submits that the petitioner is a student and is in jail since one and half month; and that this Court in the very same crime granted regular bail to Accused nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68 vide order dt.01.08.2022 in Crl.P.Nos.6610, 6611 and 6612 of 2022.

Learned Assistant Public Prosecutor opposed the bail application.

In the said circumstances, the petitioner who is a student and is in jail since one and half month and as seen from the remand case diary so far 43 witnesses were examined, this court deems it appropriate to grant the relief of regular bail to this petitioner.

Accordingly, the Criminal Petition is allowed and the petitioner/A70 is granted bail subject to the following conditions:

i) The petitioner/A70 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of Special Judge for Trial of Offences under SCs & STs (POA) Act-cum-Additional Metropolitan Sessions Judge, Secunderabad.

ii) The petitioner/A70, after release shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of three months and thereafter as and when required, for the purpose of investigation.

iii) The petitioner/A70 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
