HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.27542 of 2008 ORDER:

Heard both the learned counsel.

The prayer sought in the writ petition is as under: " For the reasons stated in the accompanying affidavit, it is hereby prayed that this Court may be pleased to issue a writ, order or direction more particularly in the nature of writ of mandamus, declaring declaring the action of the respondents in taking steps for changing the alignment of the Kankipadu Bypass Road which is part of National Highway No. 9 thereby affecting the properties of the petitioners situated in Sy. Nos. 319/ 1 319/ 2 in Punadipadu village of Kankipadu Mandal Krishna District and taking steps to dispossess the petitioners, as illegal arbitrary, high handed and violative of Articles 14 and 300A of the Constitution of India and also the provisions of National Highways Act, 1956 and consequently direct the respondents to refrain from doing so and to form the Kankipadu Bypass Road as per the Original alignment and to pass such other relief or reliefs as this Court may deems fit and proper in the circumstances of the case." 3.

During the course of hearing, the learned Government Pleader produced the letter dated 2.11.2018 addressed by the Joint Collector-II & Revenue Divisional Officer, Vijayawada to the Government Pleader for Land Acquisition. Perusal of the said letter would indicate that the petitioners herein have participated in the award enquiry and received compensation for a sum of RS.5,94,423/ - and Rs.1,73,373/ -. It is also mentioned in the said letter that one Smt. Yarlagadda Surya Sri wife of the first petitioner purchased the land from the second petitioner. Therefore, Smt.Yarlagadda Surya Sri has received compensation for the land claimed by the second petitioner in the present writ petition. As such, this Court is of the opinion that no further orders are required in the writ petition. The copy of the said letter along with the enclosure

evidencing the disbursement of the amount with photo I.Ds. is made part of the record.

Accordingly, the writ petition is closed. There shall be no order as to costs.
