M/S.Sai Srinivasa Industries (Rice Mill) v. The State Of Telangana

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23976 of 2019 O R D E R:

In this writ petition, grievance of the petitioner is that the respondents are not allotting paddy to it for custom milling for Kharif and Raby season 2019-20.

Heard learned counsel for both the parties.

It is not in dispute that the allocation of custom milling of paddy for State procurement is governed by G.O.Ms.No.17, dated 27.09.2019, particularly guidelines F and H of Annexure IV appended thereto.

Today, learned Government Pleader for Civil Supplies placed before this Court the written instructions dated 01.11.2019 received from respondent No.4, wherein it is stated as under: "Vide reference 4th cited, the President, Mahabubabad District Rice Millers Welfare Association, Mahabubabad has been requested to submit CMR participation Rice mills list. The same is awaited. It is submitted that, after receipt of CMR participation Rice mills list from the Rice Millers Association, the Deputy Tahsildars (CS) shall inspect the Rice Mills and submit the reports to the Collector (CS). Basing on the Rice mill wise recommendations by the Deputy Tahsildars (CS), verification of previous performance and also CMR 2019-20 guidelines, the concerned Rice Millers will approved for participation in CMR Paddy of Kharif 2019-20 season and list will send to the District Manager, Telangana State Civil Supplies

Corporation Limited, Mahabubabad to make agreements with the Rice Millers concerned."

In the light of the above, the writ petition is disposed of with the direction to the respondent authorities to consider the case of the petitioner subject to its eligibility in terms of the afore-stated G.O.
