THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9737 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.1 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.22 of 2016 on the file of Nakkapalli Police Station, Visakhapatnam District, registered for the offence punishable under Section 20(b) of the NDPS Act.

Heard and perused the material available on record. It is alleged that the petitioner was found in possession of 200 kgs of ganja.

Learned Counsel for the petitioner submitted that the petitioner did not commit any offence and he was falsely implicated in the above crime and that the petitioner has been in judicial custody since 5.3.2016.

Learned Additional Public Prosecutor opposed this petition on the ground that the ganja seized from the possession of the petitioner is the commercial quantity.

Considering the facts and circumstances of the case and the quantity of ganja seized from the possession of the petitioner, this Court is not inclined to grant bail to the petitioner at this stage.
