The petitioner/ A1 filed this petition under Section 438 Cr.P.C. seeking anticipatory bail in the event of his arrest in connection with Crime No.5 of 2017 on the file of Mothugudem Police Station, East Godavari District, registered for the offences punishable under Section 8(c) r/ w 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

It is alleged by the prosecution that the role of petitioner/ A1 is ascertained from the confession of A2 and A3 that he is the person behind the entire transportation of ganja, in total 530 kgs., seized from the lorry. The petitioner went unsuccessful by dismissal order in Crl.M.P.No.1656 of 2017, dated 30.10.2017 passed by the learned I Additional Sessions Judge, East Godavari at Rajamahendravaram. 3.

Heard the learned counsel for petitioner and the learned Public Prosecutor and perused the bail application averments, F.I.R. and the material on record.

From perusal of the record and from the expression of the Apex Court in Satpal Singh v. State of Punjab in Crl.A. No.462 of 2018 S.L.P. (Crl) No.8184 of 2017 dated 27.03.2018, this Criminal Petition is dismissed, which is without prejudice to the petitioner to move for regular bail after surrendering to decide on own merits.
