HONOURABLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1930 of 2016 ORDER:

This Contempt Case was instituted alleging willful disobedience to the order dated 11.12.2015 passed in Writ Petition No.37431 of 2013.

The complaint of the writ petitioner therein was that the mining authorities were interfering with his quarrying activities despite his doing so in the leased area.

As the learned Assistant Government Pleader for Mines and Geology, State of Telangana, fairly conceded before the Court that in the event the petitioner conducted his quarrying operations within the leased area, the mining authorities would not object, the said stand was taken on record and the Writ Petition was closed. Alleging disobedience to this order, the present Contempt Case was filed. However, the allegation of the petitioner in para 6 of the affidavit filed in support of this Contempt Case is that some other society, which was granted a mining lease, was trying to encroach upon his land and start quarrying illegally. The petitioner's complaint is that no action was taken against the said society and the same amounts to willful disobedience to the order passed in Writ Petition No.37431 of 2013. As this Court never issued any directions whatsoever and only recorded the undertaking that the mining authorities would not interfere with the petitioner's mining activities if he undertakes the same in his leased area, this Court is at a loss

SK, J CC.No.1930 of 2016 Dt:12.7.2019 to understand as to how the alleged actions of some third party society can be brought within the scope of that order. The Contempt Case is utterly misconceived and is accordingly dismissed. No order as to costs.
