HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 1125 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This appeal is directed against the order, dated 23.04.2015, passed in W.P.No.12052 of 2015 filed by respondent Nos.1 to 7 - writ petitioners.
The writ petitioners had challenged the notification, dated 17.04.2015, detaining them to write B.Tech., III year II semester examinations in the appellants' engineering colleges. Learned Single Judge allowed the writ petition and directed the respondents - appellants to allow the writ petitioners to write B.Tech., examination of various disciplines. We are informed that after this order, all the students listed in the notification, dated 17.04.2015, appeared and many of them have cleared the examination.
This appeal is preferred by the appellants' institutions after more than four months of the order of learned Single Judge. In view thereof, we are not inclined to interfere with the said order. We, however, make it clear that the impugned order shall not be treated as precedent and it is always open to the appellants to raise all contentions, as raised in the instant appeal, in appropriate proceedings.
Writ appeal is dismissed.
Miscellaneous petitions, if any, shall also stand dismissed.
