HON'BLE SRI JUSTICE S.V.BHATT W.P.No.7839 OF 2012 ORDER:

The petitioner/President of Markapur Cooperative House Building Society Limited, Markapur, challenges Rc.No.342/2012 D, dated 17.02.2012 issued under Section 51 of A. P. Cooperative Societies Act, 1964, as illegal and contrary to the material available on record.

The 2nd respondent filed petition to vacate the interim order dated 21.03.2012 in WPMP No.9933 of 2012 and at the time of hearing the petition, it is brought to the notice of this Court that the petitioner on 11.12.2012 represented to the respondents to change the Enquiry Officer and accepting his request, proceedings Rc.No.783/2012-HR3 dated 17.12.2012 was issued authorizing N.Surender Babu, Assistant Registrar, Office of District Cooperative Officer, Ongole to conduct enquiry into the affairs of Markapur Cooperative House Building Society Limited, Markapur. Therefore, from the changed circumstances, it is evident that on the representation of the petitioner, in the place of 4th respondent, N.Surender Babu is authorized to conduct enquiry under Section 51 of the Act.

I have perused the original record and I am satisfied that the writ prayer need not be considered at the stage of the matter. The writ petition is disposed of and the Enquiry Officer, it is hoped and believed, will ensure fairness in action and objectivity in conducting enquiry under Section 51 of the Act.

With the above observations, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
