HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20994 of 2017 ORDER:

This writ petition is filed by the petitioner aggrieved by the inaction of respondents Nos.2 to 4 in raising height of road in front of his house in terms of the sanction, in spite of his representation dated 11.3.2017. 2.

The case of the petitioner is as follows:

The petitioner is the owner of a house bearing No.18-67/B Santhinagar, Tiruvuru, Krishna District. There is a road in front of his house towards eastern side leading from the house of one Mr. A. Krishnaiah to the house of Mr. Robert. Originally, on 10.2.2016, the 2nd respondent granted sanction to lay a road from the house of A. Krishnaiah to the house of Mr. Seethapathi. In fact, there was no sanction to lay a road in front of the house of the petitioner. But the said road was extended in front of his house also without there being any sanction order. While laying the road in front of the house of the petitioner instead of excavating at the depth 0.15 cm., the respondents have got excavated 60 cm., depth. They have laid underground low level road. The petitioner submitted several representations. But no action has been taken so far. 3.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that the respondents laid low level road in front of his house and he made a representation to respondents Nos.2 to 4. But no action has been taken so far.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: "Respondents Nos.2 to 4 are directed to consider the representation of the petitioner and take appropriate action, within a period of two weeks from the date of receipt of a copy of this order." 6.
