HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40676 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking the following direction: " ..... to issue a writ, order or direction more particularly one in nature of writ of Mandamus declaring the action of the Respondent Nos.2 to 4 in not issuing the Re-Survey Report to the petitioner, the resurvey conducted by the 4th respondent on 21-10-2016 in the petitioners private patta land in Sy.No.730 admeasuring Ac.0-35 gts. in Palavancha Village and Mandal, Kothagudem District as per the petitioner representation dt.07-11-2016 as highly illegal, arbitrary and against the Constitution of India and consequently direct to the Respondents Nos.2 to 4 to issue the ReSurvey Report to the Petitioner herein in his private patta land in Sy.No.730 admeasuring Ac.0-35 gts., in Palavancha Village and Mandal, Kothagudem District as early as possible and pass such order or orders as this Hon'ble Court deems fit just and proper in the circumstances of the case."

Heard the learned counsel for the petitioner as well as the learned Government Pleader for Revenue. With their consent the Writ Petition is disposed of at the admission stage itself. The limited grievance of the petitioner in this writ petition is that the respondents were not furnishing a copy of the re-survey report conducted by the 4th respondent on 21.10.2016, hence, requests for a suitable direction to the respondents for furnishing a copy of the report of re-survey.

Learned AGP also accepts the request of the petitioner. Having regard to the same, the Writ Petition is disposed of directing the respondents to send a copy of the report of re-survey conducted on 21.10.2016 by the 4th respondent in respect of land admeasuring Ac.0-35 gts. in survey No.730 situated in Palavancha Village and Mandal of Kothagudem District, through Registered Post with Acknowledgment Due within a period of two weeks from the date of receipt of a copy of this order.
