HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.6996 OF 2019 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.286 of 2019 on the file of the Judicial First Class Magistrate, (For Prohibition & Excise Offences) at Nalgonda.
A charge sheet came to be filed against the petitioners/A-4 and A-6 for the offences punishable under Sections 120-B, 464, 420, 447, 427 and 506 read with Section 34 of the Indian Penal Code.
Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioners in C.C.No.286 of 2019 on the file of the Judicial First Class Magistrate, (For Prohibition & Excise Offences) at Nalgonda, is hereby dispensed with except on the dates when their presence is specifically required by the Court.
With the above direction, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this Criminal Petition, shall stand closed.
