The case of the petitioner is that he is the owner and possessor of different extents of land admeasuring Ac.0.04cents in Sy.No.125/8, Ac.0.02 cents in Sy.No.247/5, Ac.0.32 cents in Sy.No.212/3, Ac.0.12 cents in Sy.No.212/2, Ac.0.40 cents in Sy.No.246/9, Ac.1.28 cents in Sy.No.193/1, Ac.1.31 cents in Sy.No.124/038, Ac.0.30 cents in Sy.No.96/9, Ac.0.21 cents in Sy.No.96/13, Ac.0.28 cents in Sy.No.288/10 and Ac.0.35 cents in Sy.No.96/14. While so, taking advantage of absence of the petitioner in the village, petitioner's brother and sister got mutated their names in respect of the above said lands. Petitioner made a representation narrating the above facts to the respondent authorities. As no action has been taken, petitioner filed W.P.No.22667/2016.

This Court dismissed the said writ petition granting liberty to the petitioner to approach the 2nd respondentDistrict Collector. Pursuant to the said order, the petitioner filed representation dated 28.10.2016 to the 2nd respondent. As no orders are passed on the same, the present writ petition is filed. Learned Assistant Government Pleader for Revenue submits that petitioner has not filed Revision as per the procedure envisaged under Rule 23 of the Rules framed under the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act').

Learned counsel for the petitioner submits that petitioner will prefer Revision as per the Rules.

Though petitioner was granted liberty to file Revision under Section 9 of the Act, he made a representation to the 2nd respondent and is seeking a direction for disposal of the same, which cannot be granted.

In view of the above facts and circumstances, it is open for the petitioner to prefer Revision before the 2nd respondent and on filing of such Revision, the 2nd respondent is directed to dispose of the same in accordance with law and pass orders. With the above direction, the writ petition is disposed of. No costs.
