HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23995 of 2019 ORDER:

The case of the petitioner is that he made an application dated 23.8.2018 for release of power supply to the subject premises, but so far no orders are passed by the respondents. Aggrieved by the same, the present Writ Petition is filed. Heard learned counsel for the petitioner and Sri R.Vinod Reddy, learned Standing Counsel for respondent Nos.1 to 4. Learned counsel for the petitioner would submit that in similar circumstances, this Court disposed of Writ Petition No.31270 of 2017 by order dated 15.9.2017 and prayed to pass similar order in this Writ Petition also.

Per contra, Sri R.Vinod Reddy, learned Standing Counsel for respondent Nos.1 to 4, would submit that the petitioner has not obtained building permission in respect of building constructed, and as such, the present Writ Petition is not covered by the aforesaid order of this Court.

In this case, it is to be seen that the application submitted by the petitioner for release of power supply for the subject premises is pending consideration with the respondents. In such event, it is for the respondents to dispose of the same by considering above facts and pass appropriate orders thereon in accordance with law informing the same to petitioner.

In view of the same, without expressing any opinion on the merits of the case, this Writ Petition is disposed of, directing the respondents to dispose of the application of the petitioner after considering the aspect raised by learned Standing Counsel in accordance with law and communicate the same to the petitioner. As a sequel, Miscellaneous Petitions, if any, pending shall stand disposed of. No order as to costs.
