THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19729 OF 2016 ORDER:

Heard the learned Counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, for respondent No.1, learned Government Pleader for Revenue for respondent No.2 and Sri D.Pandu Ranga Rao, learned Standing Counsel for Municipality, for respondents 3 to 5. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in not conducting the survey in the petitioner's land admeasuring 672 square yards in Sy.No.675/1 CAS No.672, 673, 675 and 677 Nellore Bit-I in L.P.No.76/88 and 345/87, as illegal and arbitrary, consequently, to direct the authorities to consider the representation No.2015-TP-0853, dated 01.09.2015.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the representation dated 01.09.2015 made by the petitioner for survey of land in Magunta Layout, Nellore, at the earliest.

4. Learned Standing Counsel for Municipality submits that if such representation is still pending consideration and it is otherwise in order, the authorities will deal with it, in accordance with law.

5. In view of the above and without going into the merits of the case, the Writ Petition is disposed of directing the 4th respondent to dispose of the representation dated 01.10.2015 made by the petitioner for survey of the land admeasuring 672 square yards in Sy.No.675/1 CAS No.672, 673, 675 and 677 Nellore Bit-I in L.P.No.76/88 and 345/87, if the same is still pending consideration and otherwise in order, in accordance with law, as early as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
