THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition Nos.20583 and 20799 of 2015 COMMON ORDER:
These two writ petitions are filed seeking third phase counseling in respect of unfilled seats in the Post Graduate Medical Courses for the academic year 2015-16. It is the admitted case of the parties that Postgraduate Medical/Dental Admission schedule for the academic year 2015-16 was fixed by the Supreme Court on 24.03.2015 in the case of Ashish Ranjan & others v. Union of India & others. The last date up to which students can be admitted against vacancies arising due to any reason from the waiting list for the academic year 2015-16 is fixed as 10th June, 2015.
In view of the said schedule, these writ petitions, at this stage, cannot be entertained.
The learned counsel for the petitioners argued that some seats remained unfilled due to vacation made by the admitted post graduates by choosing prime institutions whose counseling took place subsequent to the closure of the counseling conducted by Dr. N.T.R. University of Health Sciences and without taking that fact into consideration the University simply adhered to the schedule fixed by the Supreme Court in the matter of admission to Postgraduate Medical/Dental courses by Dr. N.T.R. University of Health Sciences. This Court cannot direct the University to conduct 3rd phase counseling after the cut off date fixed by the Supreme Court was over, merely on the ground that some students vacating the seats after selecting them in the counseling. Therefore, if the petitioners had any
grievance, they ought to have approached the Supreme Court for modification of the schedule or seeking appropriate directions in that regard.
For the aforesaid reasons, the writ petitions are not maintainable at this stage and are accordingly dismissed. Miscellaneous Petitions, if any pending in these writ petitions shall stand closed. No order as to costs.
