THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.20936 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Endowments.

According to the petitioner he is the Archaka and member of the founder's family of Sri Narasimha Swamy Temple, Chinna Thumbalam Village, Peddakadabur Mandal, Kurnool District, appointed by the Endowments Department, vide appointment orders, dated 30.12.1992, after the death of his father on 15.12.1991. It is further stated that he is a postgraduate and he got through 'Vara' and 'Pravara' examinations with Tantrasara Agamam, conducted by the Endowments Department, and also passed 'Tantrasara Agamam' in Sri Guru Sarvabhouma Sanskri Vidyapeetha, Sree Raghavendra Swamy Mutt, Mantralayam, Kurnool District. It is further averred in the writ affidavit that the above said temple was built by his fore-father, Sriman Krishnachar, who was the trustee-cum-Archaka of the temple from 1735 to 1788.

It is further averred that the Assistant Commissioner of Endowments, on instructions of the Commissioner of Endowments, Andhra Pradesh-second respondent herein, furnished the particulars of the institutions having income below Rs.2,00,000/-, to be handed over to the founder family members of the Archaka. In support thereof, letter bearing Rc.No.A6/4487/2012, dated 02.08.

the petitioner along with the Writ Petition, wherein the name of the present institution was shown at S.No.30 so also the name of the petitioner herein as 'Archaka'.

During the course of arguments, it is submitted by the learned counsel for the petitioner that, for redressal of his grievance, petitioner herein got issued a legal notice, through his counsel on 30.11.2017, but no action has been taken by the Commissioner of Endowments, Andhra Pradesh-second respondent herein, who is the competent authority. It is requested by the learned counsel for the petitioner that the same may be treated as representation of the petitioner herein and orders be passed by the first respondent in accordance with law.

Recording the above submission, without expressing any opinion on the merits of the Writ Petition, the Writ Petition is disposed of, directing the Commissioner of Endowments, Andhra Pradesh-second respondent herein to verify the legal notice, dated 30.11.2017, and take appropriate action, strictly in accordance with law, within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
