The writ petition is filed questioning the inaction of respondents 2 to 4 in registering FIR against respondents 10 to 17 on the basis of the written complaint dated 03.07.2019 submitted by the petitioners. Heard learned counsel for the petitioners and learned Government Pleader for Home.
Learned Government Pleader, on written instructions dated 03.11.2019, would submit that upon receipt of the complaint from the petitioners on 03.07.2019, a GD entry was made on 17.07.2019, vide Sl.No.25 at page No.648 of the GD Register, and after going through the contents of the complaint, since it is revealed that the complaint did not disclose any cognizable offence and it is civil in nature, the petitioners were directed to approach competent Court of law or appropriate forum for redressal of their grievance. It is stated that a detailed reply notice dated 31.10.2019 was sent to the petitioners through registered post on 02.11.2019. A copy of the said communication, along with the track report evidencing such registered post, is placed on record. A copy of such communication is also handed over to the learned counsel for the petitioners across the Bar.
Inasmuch as the communication has been sent to the petitioners stating that the dispute is civil in nature, it is open for them to avail appropriate remedies in accordance with law.
