HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21074 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue a writ, order or direction more particularly one in the nature of writ of Certiorari declaring the orders of the 2nd respondent in F.No.19 (3) / Hyderabad/ RD(SER)/Sec.140/2018 dated 31.05.2018 (received by the petitioner on 5th June 2018) as illegal, arbitrary, violative of principles of natural justice and quash the same." 2.

Heard learned counsel appearing for the parties. 3.

The matter underwent several adjournments. When the matter is listed today, the learned Assistant Solicitor General appearing for respondents 1 and 2 again seeks further time. 4.

The only grievance of the petitioner is that without giving an opportunity of hearing on 17.05.2018, the impugned order came to be passed; that no notice of hearing of the case was issued to the petitioner before passing the impugned and thereby violated the principles of natural justice and hence, he prays to set aside the impugned order.

Learned counsel for the petitioner would submit that the petitioner also resigned as Auditor from the 3rd respondent company and a copy of the same was served on the counsel for the 3rd respondent.

In the facts and circumstances of the case, the impugned order, dated 31.05.2018 is set aside. Since the petitioner has already submitted resignation letter and the same was served on counsel for

respondent No.3, the Writ Petition is allowed to the extent indicated above.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
