This writ petition is filed declaring the action of the respondents 4 and 5 in not conducting survey and fixing the boundaries in respect of he lands in S.No.8/3 to an extent of Ac.1.74 cents Pamanaboyanapalle Village, Ramakuppam Mandal , Chittoor District, as illegal and arbitrary and for a consequential direction to the respondent 3 and 5 to implement the order of the District Collector dated 23.04.2015. Learned Assistant Government Pleader for Revenue submits that petitioner has not made the Director, Survey and Land Records, Chittoor District, as a party to this writ petition. He also submits that petitioner has to make necessary application for conducting survey of the subject land. Learned counsel for the petitioner submits that petitioner will make necessary application to the 4th respondent for conducting survey and fixing boundaries, in respect of the subject land.
In this case, it is to be seen that petitioner made an application on 30.05.2014 to the Director, Survey and Land Records, Chittoor District, who is not made a party to this writ petition. Even in the proceedings dated 23.04.2015, the District Collector directed the 4th respondent to look into the request made by the petitioner for solving the land disputes in respect of the subject and intimate the same to the petitioner directly.
In view of the above facts and circumstances, it is open for the petitioner to make necessary application to the 4th respondent by paying necessary fee, for conducting survey and on such application being made by the petitioner, the 4th respondent is directed to dispose of the same and take action accordingly.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 14.02.2017 dv
