THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28900 OF 2017 ORDER:

This writ petition is filed seeking the following relief:- "... to issue an appropriate writ, order or direction, more particularly one in the nature of writ of mandamus declaring the proceedings in L.Dis.No.A1/1875/2016, dated 02.11.2016 issued by the 3rd respondent and the proceedings in Rc.No.A4/1499/2016, dated 01.04.2016 issuing by the 4th respondent rejecting the right of the petitioner relating to landless poor certificate to cultivate the land in an extent of Ac.5.50 cents in R.S.No.353/2A of Kadiyapulanka village of Kadiam Mandal of East Godavari District belonging to the 5th respondent and the auction conducted for lease hold rights of the said land as illegal, null, void, arbitrary and contrary to the statutory rules consequently direct the respondents to consider the application of the petitioner, dated 16.01.

2017 to issue certificate to continue the petitioner to cultivate the said land and to pass such other order or orders." Learned counsel for the respondents submits that against the impugned order, there is a provision of Appeal to the Regional Joint Commissioner of Endowments.

In view of the same, the learned counsel for the petitioner is permitted to file Appeal before the competent Authority, within a period of thirty days from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in the writ petition shall stand closed.
