THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9008 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondents herein in imposing the punishment of recovery of an amount of Rs.25,957/- from the petitioner in concerned with losing of Tickets is bad, arbitrary, illegal, unjust, unreasonable by setting aside the Final Order No.P2/802(1)/2015-GDWL, Dt. 15-022016 of 3rd respondent herein and consequently direct the respondents not to recovery any amounts if recovered direct to repay the amounts to the petitioner forthwith by allowing the said WP and pass such other order or orders which this court deems fit and proper."

2. Heard Sri P.Venkateshwer Rao, learned counsel, appearing for the petitioner and Sri B.Mayur Reddy, learned standing counsel, appearing for the respondent Corporation.

It is submitted by the learned counsel for the petitioner herein that the issue in the present writ petition is squarely covered by the orders of this Court in W.P.No.23115 of 2008, dated 13.12.2010 and a copy of the same is also placed on record along with the writ petition as material paper. The same is not disputed by the learned standing counsel.

4. Following the above said judgment and for the reasons recorded therein, the Writ Petition is allowed, setting aside the impugned proceedings bearing No.P2/802(1)/2015-GDWL, dated 15.02.2016 and the respondent Corporation shall work out the cost of the paper and the printing charges liable to be recovered from the petitioner on

account of the loss of the block of tickets.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 18.03.2016 SS
