Petitioner And State of Telangana, Rep., by its Principal Secretary, Panchayat Raj & Rural Employment Department, Secretariat, Hyderabad & others.
.. Respondents This court made the following :
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7931 of 2017 ORDER :
Petitioner is placed under suspension by order dated 19.08.2016. Aggrieved by the order of suspension, petitioner preferred appeal before the Commissioner & Director, Panchayat Raj & Rural Employment, State of Telangana (2nd respondent). Contending that the appeal is not disposed of so far and there is no progress in the enquiry, and that the petitioner is now under suspension, this writ petition is filed.
2.
When the matter is taken up for consideration, learned counsel for the petitioner fairly submits that since the appeal is pending, petitioner would be satisfied if the writ petition is disposed of directing the appellate authority to consider the appeal and pass orders within a fixed time frame.
3.
Having regard to the said submission, the Writ Petition is disposed of, without expressing any opinion on merits, directing the 2nd respondent to consider the appeal filed by the petitioner received by him on 24.08.2016 against the order of suspension from service and pass appropriate orders, as warranted by law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
