THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38752 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed to declare the action of the respondents in issuing tender notification in respect of Outsourcing Agency issued by the 3rd respondent published in Andhra Jyothi on 03.11.2016 as arbitrary and illegal. It is the case of the petitioner that the panel prepared by the respondents for the financial year 2016-2017 for supply of manpower is pending with the authorities wherein the petitioner-Society is listed at Serial No.14. But, it is the apprehension of the petitioner that in view of the fresh tender called for by the 3rd respondent, it may be prevented from supplying manpower as per the proceedings dated 01.10.2016. The learned Government Pleader for Labour (A.P.)
on instructions, submitted that the tender notification which is assailed in the writ petition is nothing to do with the functioning of the petitioner herein more particularly, the said tender will not prevent the petitioner from supplying manpower for the financial year 2016-2017. Further the learned Government Pleader clearly asserted that the said notification is nothing to do with the functioning of the petitioner for the financial year 2016-2017. In view of the said submission, nothing remains for adjudication in the writ petition.
Recording the above submission of the learned Government Pleader for Labour, the writ petition is closed. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 10.11.2016.
