HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.858 of 2015 ORDER:
This revision is preferred challenging the order dated 12-05-2015 passed by the IX Additional District & Sessions Judge at Chittoor in Crl.M.P. No.45 of 2014 in C.A. No.112 of 2015, wherein the learned Sessions Judge suspended the sentence to pay compensation of Rs.7,50,000/- within two months, on condition of petitioner depositing a sum of Rs.1,87,500/- within one month from the date of the order.
The grievance of the petitioner is that the appeal itself is preferred against imposition of fine and such a condition imposed by the appellate Court is excessive and exorbitant. It is further submitted that petitioner is not in a position to pay such huge amount. Considering the same, the order dated 12-05-2015 passed by the IX Additional District & Sessions Judge at Chittoor in Crl.M.P. No.45 of 2014 in C.A. No.112 of 2015 is set aside directing the petitioner to execute a bond for a sum of Rs.5,00,000/- (Rupees Five Lakhs only) and on such execution, the lower appellate Court is directed to suspend the sentence and dispose of the case in accordance with law.
Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
