THE HON'BLE SRI JUSTICE P NAVEEN RAO ORAL ORDER:

Petitioners are working as Lecturers (Chemistry) in Government Degree College- Co-education, Adilabad. Petitioners are now seeking transfer in the impeding transfer exercise on lifting the ban on transfers. 2.

Learned counsel for petitioners raise two contentions, one alleging improper conducting of transfer counselling and extension of cut off date from 31.5.2018 to 31.8.2018 and secondly not notifying three vacancies at Government Degree College, Co-education, Nirmal town. According to learned counsel, though there are three posts of Lecturer (Chemistry) in the said college, in the transfer counselling none of the said posts are shown denying opportunity to petitioners to exercise their option.

With reference to second aspect, learned Assistant Government Pleader, on instructions, would submit that though three post of Lecturer (Chemistry) are sanctioned at Nirmal college, in view of reduction in intake capacity of students, Government decided not to fill one post; that one Lecturer is long standing and has to be compulsorily transferred and he is participating in the transfer counselling, however, on his transfer that vacancy will not be filled up. With reference to two other vacancies, one is due for retirement in August, 2018, therefore, he is not being disturbed and other person joined in College only last year, therefore, not liable for transfer.

In view of this clarification, it cannot be said that arbitrarily these vacancies are not shown in the transfer counselling, as sought to be contended by the learned counsel for petitioners.

With reference to extension of cut-off date to compute completion of two years of service coming within the purview of transfers, same issue is considered in W.P. No. 20475 of 2018 and this Court has not agreed with the said contention and said writ petition was dismissed vide order dated 21.6.2018 confirming the Government decision to extend the cut off date prescribed in G O Rt No. 117 Higher Education (TE) Department dated 7.6.2018.

In view of the same, there are no merits in the writ petition, accordingly, the same is dismissed. No costs. Miscellaneous petitions, if any pending, are closed.
