HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.73 of 2009 ORDER:

This Writ Petition has been filed by the petitioners stating that they are in possession of land in Sy. Nos.134, 135 and 136 in Gachbowli village, Serilingampally Mandal, Ranga Reddy District and that they have constructed houses in an extent of 60-100 sq yds and obtained water connection, electricity connection and also ration cards.

They claim that in view of their long pending occupation of the property, they had made representations to the respondents for issuance of pattas in their favour in respect of the land as well as the houses and that the respondents are not disposing of the said representations.

The petitioners have no where stated in their affidavit that their possession in their occupation of the land is traceable to any lawful title. They do not dispute that the subject land is Government land and it is also not their case that any patta either house site patta or an assignment patta has been issued in their favour and it is their case that pattas earlier granted to assignees had been cancelled. 4.

Merely because assignments made earlier had been cancelled, it does not confer any right on the petitioners to grab the property in their possession and under the guise of interim orders

MSRJ W.P.No.73 of 2009 granted by this Court on 20-03-2009 in W.P.M.P.No.71 of 2009 to continue in possession thereon.

Therefore, the Writ Petition is dismissed on the ground that the petitioners are land grabbers and are not entitled to consideration of any of their claims for assignment of land or allotment of house site pattas and the interim order dt.20-03-2009 granted by this Court in their favour is vacated. The respondents shall immediately take steps to evict the petitioners from the premises in their occupation in the subject land. No costs. 6.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
