Petitioner herein has already approached the civil court and stated to have obtained interim orders of attachment, and when the respondent - Bank is conducting auction of the subject property, which is in attachment, it is open for him to seek appropriate relief before the civil court, where the suit is pending, or avail any other alternative remedy against conducting of auction and he cannot maintain the writ petition questioning the auction. In view of the same, writ petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed.
