THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38174 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to call for the records relating to FIR No.153 of 2016 and to quash the same.

Heard and perused the material available on record. The case of the petitioners is that the 3rd respondent lodged the present complaint against the petitioners alleging that the petitioners by putting their thumb impression, misappropriated the amounts pertaining to the old age pension and basing on the said complaint, the 2nd respondent registered the same as Crime No.153 of 2016 for the offences under Sections 409, 420, 468, 471 read with 34 IPC. The main grievance of the petitioners is that due to the dispute between the officials of the Municipal Office, Venkatagiri, and the Ward Councillors, the petitioners were made scapegoats and the 3rd respondent, in order to safeguard them, dragged the innocent petitioners into the false and frivolous case without there being any iota of evidence to connect the petitioners to the alleged offence.

Considering the grievance of the petitioners and since the entire evidence is based on the documents, the 2nd respondent is directed to complete the investigation in FIR No.153 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to appear before the 2nd respondent and give their signatures and hand writing to the 2nd respondent for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 6th December, 2016 KL
