THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.280 of 2016 ORDER:
This application is filed to withdraw O.P.No.400 of 2016 from the file of Additional Family Court - cum - XV Additional District Judge, Miyapur, and transfer the same to Court of Senior Civil Judge, Machilipatnam, Krishna District.
2. Wife filed this application. According to her affidavit, her marriage with respondent was solemnized on 31.05.2015 at N.Gardens, Kukatpally, Hyderabad, as per Hindu rites and caste custom and that marriage was consummated. She stated that due to disputes, she was driven out from her matrimonial home and she is now residing with her parents. She stated that she lodged a compliant at Women Police Station, Krishna, and the same is registered as Crime No.3 of 2016 and thereafter, she received summons from Family Court, Ranga Reddy District at L.B.Nagar, in the O.P. filed by her husband seeking restitution of conjugal rights.
She further stated that she has no financial capacity to meet travel expenses from Machilipatnam to Ranga Reddy District and that she has no male assistance to accompany her from Machilipatnam to Ranga Reddy District, which is more than 300 kilometres. She stated that she apprehend danger to her life in the hands of respondent at Hyderabad. For these reasons, she prayed for transfer of O.P.No.400 of 2016 from Additional Family Court - cum - XV Additional District Judge, Miyapur, to Court of Senior Civil Judge, Machilipatnam, Krishna District.
3. Respondent, in spite of granting time, did not file any counter disputing the affidavit averments of petitioner.

Considering the reasons stated in the affidavit filed in support of this petition and also considering the convenience of wife, O.P.No.400 of 2016 is withdrawn from the file of Additional Family Court - cum - XV Additional District Judge, Miyapur, and transferred to Court of Senior Civil Judge, Machilipatnam, Krishna District, for disposal in accordance with law.
6. The petition is ordered accordingly. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed. ___________________ S. RAVI KUMAR, J 17th August, 2016.
