THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23599 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ or direction or Order, in the nature of writ of Mandamus, declaring the inaction of the Commissioner of Vijayawada Municipal Corporation, to dispose the petition of the Petitioner dated 11-05-2017, filed against the Endorsement dated 11-04-2017 in Rc.No.F9-105228/17(14) of 2017 of the Chief Medical Officer of Health of Vijayawada Municipal Corporation,Vijayawada, as arbitrary, illegal, unjust and unconstitutional and to consequentially direct the Commissioner of Vijayawada Municipal Corporation, to dispose the petition of the Petitioner dated 11-05-2017, expeditiously and pass such other order or orders may deem fit and proper in the circumstances of the case." 2.

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.3 herein to dispose of revision petition filed by the petitioner vide RC.No.F9-105228/17(14) of 2017 challenging the Endorsement Notice, dated 11.04.2017, issued by respondent No.4, in accordance with law, as expeditiously as possible. 3.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.3 is hereby directed to dispose of revision petition filed by the petitioner vide RC.No.F9-105228/17(14) of 2017 in accordance with law, as expeditiously as possible,

preferably, within a period of eight (8) weeks from the date of receipt of a copy of this order. The petitioner is directed to co-operate with the revisional authority for early disposal of the said revision petition. If the petitioner fails to co-operate, the revisional authority can pass appropriate orders basing on the records available. Till disposal of the said revision petition, the respondents are directed not to take any coercive steps against the petitioner.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
