HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5933 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner/A1 under Section 482 Cr.P.C seeking to quash the proceedings in F.I.R.No.132 of 2015 of Eluru III Town Police Station registered for the offence punishable under Sections 409, 477A r/w 34 I.P.C. Heard the learned counsel for the petitioner and the learned Public Prosecutor (Andhra Pradesh) for the State, before notice to respondent No.2/de facto complainant and before admission. Perused the material on record. The material falls short for this Court to admit the application under Section 482 Cr.P.C to quash the said F.I.R. However, the factual matrix, since the petitioner is working as Assistant Registrar in Divisional Cooperative Office, Vijayawada, entitled to the concession of bail.

Having regard to the above, the petitioner has given liberty to surrender before the learned Magistrate concerned and move for regular bail with notice to the Additional Public Prosecutor and in such an event the learned Magistrate shall grant bail with necessary conditions preferably on the same day, as any detention beyond 48 hours she may lose her job.
