HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24050 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of learned counsel for the respective parties. This writ petition is filed seeking the following relief :- " ......to issue a writ, order or direction more particularly in the nature of writ of Mandamus declaring the In action of the Second Respondent in not passing any orders on the Appeal filed by the petitioner on 21/ 02/ 2018 and not considering the representation of the petitioner dated 31/ 05/ 2018 and effecting promotions to the post of Panchayat secretaries Grade-II without deciding the petitioners objections is illegal, unjust and violative of fundamental rights enshrined by Articles 14, 16 and 21 of the Constitution of India, contrary to the Judgments of Honourable Supreme Court and consequently to direct the respondents to pass orders on the Appeal of the petitioner dated 21/ 02/ 2018 and also the representation of the petitioner dated 31/ 05/ 2018 as per law before Finalising the Seniority List for the Post of Panchayat Secretary Grade-II in the erstwhile Mahabubnagar District ....." .

Heard Mr.S.S.N.Moorthy, learned counsel for the petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that he is working as a Panchayat Secretary Grade-II and the respondents have erroneously prepared the seniority list. Aggrieved thereby, the petitioner has preferred an appeal before the 2nd respondent on 21.02.2018, but, so far, the 2nd respondent has not passed any orders on the said appeal.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the 2nd respondent to

pass appropriate orders in accordanc e with law on the appeal preferred by the petitioner on 21.02.2018.

The learned Government Pleader appearing for the respondents contends that the 2nd respondent would consider and dispose of the appeal preferred by the petitioner on 21.02.2018 in accordance with law within a reasonable time frame. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the 2nd respondent to consider and dispose of the appeal preferred by the petitioner on 21.02.2018 in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
