2018-06-21A.Rajasheker Reddy3 pages

HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.20837 of 2018 ORDER:

It is the case of the petitioner that on 29-05-2018, the 5th respondent and his men entered in to the house of the petitioner and demolished the same. On that the petitioner gave a complaint to the police and basing on the said complaint, a case in Cr.No.52 of 2018 was registered. That the petitioner is trying to reconstruct the house, the 5th respondent is not allowing him to reconstruct the same and on that the petitioner approached the police to provide police protection for construction of the house. As no action has been taken, the present writ petition is filed. Heard learned Assistant Government Pleader for Home. It is to be seen that the matter appears to be purely civil in nature, as there are disputes pending between the petitioner and the 5th respondent. Though the petitioner sought a direction to the police to provide police protection, this Court cannot straightaway grant such a direction to the police unless the said disputes are decided by competent Court.

In view of the same, no relief can be granted to the petitioner. However, it is open for the petitioner to avail alternative remedies available to him.

With the above observations, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
