THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39986 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to call for the records in FIR No.131 of 2016 and to quash the same.
Heard and perused the material available on record. The case of the petitioner is that the 3rd respondent lodged the present complaint against the petitioner alleging that on 19.09.2016, the son of the 3rd respondent left his house without informing anybody since the petitioner teased and cheated him in several ways and on that, the son of the 3rd respondent felt ashamed and went out of the house and since then, the 3rd respondent and his relatives searched for him, but could not able to trace him. The grievance of the petitioner is that the 3rd respondent and the 2nd respondent are harassing the petitioner and his family members by demanding amount for settlement of the issue and making efforts to arrest the petitioner and that the petitioner is apprehending arrest in the hands of the 2nd respondent.
Learned counsel for the petitioner submitted that the petitioner has nothing to do with the missing of the son of the 3rd respondent and that the petitioner is ready to co-operate with the investigation whenever he is called by the 2nd respondent for the purpose of investigation.
Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the 2nd respondent is directed to complete the investigation in the said
case, as expeditiously as possible and file a final report, if any, either way, in accordance with law, without arresting the petitioner.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 30th November, 2016 KL
