HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.21161 of 2017 ORDER:
The petitioner prays for mandamus declaring the action of respondents in effecting changes in the revenue records during the pendency of IA No.3675 of 2017 in IA No.54 of 2016 in IA No.553 of 2012 in CMA No.64 of 2010 on the file of the 1st respondent Tribunal, as illegal and arbitrary.
2. Though the grievance is sought to be canvassed against respondents 2 to 4, the petitioner in effect is attempting for expeditious disposal of IA No.3675 of 2017. No doubt CMA was dismissed on 01.02.2017. The applications have been filed for restoration. This court in fitness of things and to avoid further delay in rendering a decision on issue pending between petitioner and 3rd respondent, considers it appropriate to observe that the learned District Judge cum the Estate Abolition Tribunal, Nellore, considers disposing of the application expeditiously. The petitioner is given liberty to file copy of this order before the 1st respondent-Tribunal for expeditious disposal of the application.
3. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
