The District Level Committee granted Final Registration No.11800012202 dated 03.05.2018 in favour of the petitioner herein for undertaking fish culture in the land admeasuring Ac.2.02 cents in Sy.No.166 and 167 of Vemavarappadu village, Klkalur Mandal, Krishna District. On the basis of a complaint made by one Sri Bodavula Balaramaiah, the Assistant Director of Fisheries/third respondent herein by way of a letter bearing No.1/A/2018, dated 28.05.2018, directed the petitioner herein to stop the Prawn culture on the ground that the District Level Committee granted permission only for fish culture. In fact, according to the petitioner, after receipt of the said letter dated 28.05.2018, he submitted a representation to the third respondent stating that due to the village politics certain false complaints were given against him and that he is not undertaking the prawn culture nor he is drawing the salt water into the fish tank.

Since the issues pointed out by the petitioner are factual aspects, this Court deems it appropriate to dispose of the writ petition, with a direction to the third respondent to undertake physical inspection of the subject site and take further action in accordance with law. As a sequel, the miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
