HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39826 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the official respondents to arrest the accused and file charge sheet in FIR No.52 of 2015 on the file of the Midthur Police Station, Kurnool District.

Heard and perused the material available on record. 3.

It is stated in the affidavit that respondents Nos.6 to 9 went to the Burial ground belonged to Muslim minority, destroyed the walls and demolished the graves. On the complaint lodged by the petitioner and others, a case was registered against respondents Nos.6 to 9. But the official respondents have not arrested the accused and they have not yet completed the investigation.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion, the Writ Petition is disposed of with the following direction:

"The official respondents concerned are directed to complete the investigation and file a final report in Crime No.52 of 2015 on the file of Midthur Police Station, Kurnool District, as expeditiously as possible".

No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
