THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16492 of 2008 O R D E R:
In this writ petition, petitioner challenges the notice, dated 10.07.2008, issued by respondent No.1-Sri Lakshmi Narasimha Swamy Temple, Mangalagiri, Guntur District, directing her to pay the rent at the enhanced rate from 2004-05 to 2007-08. The petitioner asserts that before enhancing the rent, she was not put on notice and no opportunity was given to her. She also asserts that the rent was enhanced exorbitantly from Rs.475/- to Rs.7,399/- and the same is contrary to the certification of the Village Revenue Officer, Atmakuru, who had determined the same at the rate of Rs.2,000/- per acre.
In the counter-affidavit, respondent No.3 states that the market value that is fetching with respect to the neighbouring lands is Rs.5,000/- per acre and that for the land in occupation, the petitioner ought to have paid a sum of Rs.11,000/- and that as she was extended the benefit of small farmers, only a sum of Rs.7,400/- is being demanded. He also states that the petitioner was issued notice on 10.07.2008 itself as she was recognized as landless poor person only with effect from 06.11.2003. Today, when the matter is taken up, learned Standing Counsel for respondent No.3 submits that the petitioner has been paying the enhanced rent all through.
Recording the above said submission, the writ petition is closed. It is left open to respondent No.1 to seek enhancement of the rent keeping in view the prevailing market conditions.
