THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8819 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.240 of 2023 on the file of Nalgonda-I Town Police Station, Nalgonda District, registered for the offence under Section 20 (b) (ii) (A) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act') r/w. Section 9 of NDPSR.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Sub-Inspector of Police, Nalgonda-I Town Police Station arrested this petitioner for being found in possession of 2kgs. of ganja. Accordingly, a complaint was filed on 03.08.2023. Having followed the procedure prescribed under NDPS Act, according to the Police, the petitioner was remanded to judicial custody on 03.08.2023.

Learned counsel appearing for the petitioner would submit that the quantity seized is intermediate quantity. 5.

Learned Additional Public Prosecutor on instructions would submit that there are no other criminal cases pending under NDPS Act against this petitioner. 6.

Since the quantity of the contraband seized is intermediate quantity, the petitioner can be granted regular bail, subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of Judicial First Class Magistrate at Nalgonda, Nalgonda District.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer on every Monday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
