HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12399 OF 2017 ORDER:

This writ petition is filed challenging the action of the 2nd respondent in not numbering the appeal filed by the petitioner dated 26.12.2016 against the orders dated 01.12.2016 passed by the 3rd respondent.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

It is to be seen that as per proceedings of the District Collector dated 01.12.2016, appeal lies to the Commissioner (Appeals), O/o.Chief Commissioner of Land Administration, Andhra Pradesh. But, the petitioner preferred appeal before the Chief Commissioner.

Learned counsel for the petitioner also admits that the appeal lies before the Commissioner (appeals), but not before the Chief Commissioner.

Since appeal lies to the Commissioner (Appeals), no direction can be given to the Chief Commissioner-2nd respondent. In view of the same, the writ petition is liable to be dismissed. However, it is open for the petitioner to file appeal before the Commissioner (Appeals) and on filing of appeal by the petitioner, the Commissioner (Appeals) shall consider the same, in accordance with law.

Subject to above, the writ petition is dismissed. No order as to costs.
