HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.22599 of 2015 ORDER:

The 1st petitioner seeks to sell the developer's share to the 2nd petitioner in terms of the agreement entered between them and accordingly proposed to executed sale deed in respect of the property admeasuring Ac.1140.89 sq. yards, premises bearing Nos.1-7-55, 1-7-69 and 69/1 to 6 situated at S.D.Road, Secunderabad. The marked value demanded by the 3rd respondent for the purpose of stamp duty in terms of G.O.Ms.No.157, dated 30-03-2013 is questioned in this writ petition. The similar issue was already considered by this Court in W.P.No.18191 of 2015 on 23-06-2015.

In view of the same, following the aforesaid judgment, this writ petition is disposed of directing the 2nd respondent to process the petitioners document for registration by adopting the valuation as existed prior to issuance of G.O.Ms.No.157, dated 30.03.2013. It is made clear that in the event of validity of the said G.O. is being upheld, the petitioners will be liable to pay deficit stamp duty and registration fee on the revised market value and to that extent, there shall be a charge on the property covered by document directed to be registered by this order. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
