THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO C.R.P.No.2089 OF 2014 O R D E R :

The grievance of the petitioner in this Revision is that I.A.No.250 of 250 of 2013 in I.A.No.405 of 2009 in O.S.No.340 of 2009 on the file of Junior Civil Judge, Rajahmundry is not being taken up by the said Court and that the petitioner was forced to commence trial without the said application having been decided.

2. Counsel for the petitioner submits that the application I.A.No.250 of 2013 had been filed for re-entrustment of warrant to the Advocate-Commissioner in view of the fact that the report of the Advocate-Commissioner was found to contain some lacuna and that if the trial is concluded before the said application is decided, grave prejudice would be caused to the petitioner.

3. Having regard to the said submissions, I.A.No.250 of 250 of 2013 in I.A.No.405 of 2009 in O.S.No.340 of 2009 on the file of Junior Civil Judge, Rajahmundry is directed to be dispose of within a period of three (03) weeks from the date of receipt of copy of this order, positively.

4. With the above direction, this Civil Revision Petition is allowed. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
