HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioners claim that they purchased the land to an extent of Ac.1.07 guntas in Sy.No.588/EU and Ac.0.21 guntas in Sy.No.588/EE of Kondapur village through registered sale deeds. However, it was found that third person has laid fencing in the land purchased by the petitioners. In order to resolve the issue, representation was made to the Assistant Director of Survey and Land Records on 30.08.2019 requesting him to conduct survey. Alleging inaction on the said representation, this Writ Petition is filed. 2.

According to the procedure evolved by the Government, initially the authority to order survey is the Tahsildar of concerned mandal and as per the directions of the Tahsildar, the Mandal Surveyor has to conduct survey. The application for conducting survey has to be submitted in F-line mode through Online web portal and not in physical form. That being so, petitioner submitted application in physical form addressed to the Assistant Director of Survey and Land Records, who is not competent. Therefore, it cannot be said that respondents are negligent in not acting upon the request of petitioner warranting interference by this Court.

Granting liberty to petitioner to make an application as required to conduct survey, Writ Petition is disposed of. Pending miscellaneous petitions shall stand closed.
