THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24108 of 2019 ORDER:

In this Writ Petition, petitioners' grievance is that respondent authorities marked their properties for acquisition without issuing any notice.

Learned Standing Counsel for National Highways Authority of India (NHAI) appearing for the second respondent submits that the subject properties came to be acquired by NHAI as far back as in 1996 and that predecessors of the petitioners had encroached upon the land and made constructions, as there was some delay in implementation of the Highway Project. Inasmuch as no proceedings have been initiated for evicting the petitioners and considering the fact that the petitioners are in possession of the subject properties, the respondents are directed not to dispossess the petitioners without following due process of law.

Subject to the above, this Writ Petition is disposed of. Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 5th NOVEMBER, 2019.
