Heard learned counsel for petitioner and learned Government Pleader for Revenue and perused the record.

According to the petitioner, his father late Bhukya Parishya was granted ownership certificate under Section 38-E of Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act in respect of land to an extent of Ac.6-01 guntas in Sy.No.219 and admeasuring Ac.6-20 guntas in Sy.No.220 situated at Thimmapur Sivaru, Mandamarri mandal. After the death of his father, petitioner claims to be enjoying the said land without any interference and his name was also mutated in the revenue records. On 12.6.2017, petitioner made application to the authorities, requesting to conduct survey on the ground that the management of Solar Power Plant is constructing the plant in Andugulapet Sivaru, Mandamarri mandal by acquiring 150 acres of land, which is adjacent to the land of the petitioner and they are trying to encroach into petitioner's land.
Pursuant to the request made by the petitioner vide application dated 12.6.2017, a notice was issued on 20.8.2017, fixing the date as 1.9.2017 for conducting survey. According to the learned counsel for petitioner, no survey was conducted on that date and no further date was fixed and several notices were also issued, but so far no survey was conducted.

Having regard to the said submission and without going into the merits of the matter, the writ petition is disposed of, directing the 4th respondent-Tahsildar to conduct survey pursuant to the notice
issued on 20.8.2017 on the application of the petitioner for conducting survey in respect of lands in Sy.Nos.219 and 220 of Thimmapur Sivaru, Mandamarri mandal, within a period of eight (8) weeks from the date of receipt of a copy of this order, after affording due opportunity to the petitioner as well as interested persons. It is open to parties to raise objections on conducting of survey. As a sequel, the miscellaneous applications, if any, shall stand closed. __________________ P.NAVEEN RAO,J Date: 5.11.2019 DA
