HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15136 OF 2017 O R D E R :

The case of the petitioner is that the 3rd respondent issued notice dated 30.03.2017 in R.C.No.64/B/2017 to the petitioner asking him to produce the documents in support of his claim in respect of the land admeasuring Ac.21.12 sq.yards in Sy.No.787, Tadipatri Village and Mandal, Anantapur District and is threatening the petitioner to vacate the premises. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that even before filing of explanation and documents by the petitioner, the respondents are trying to evict the petitioner. On the other hand, learned Assistant Government Pleader for Revenue submits that it is only notice and it is open for the petitioner to submit necessary documents in support of his claim.

Normally this Court will not interfere at the stage of notice.

In view of the above facts and circumstances, it is open for the petitioner to file explanation and also the documents in support of his claim within a period of four (04) weeks from today. On submitting the same, the 3rd respondent is directed to pass appropriate orders in accordance with law. Till such time, status-quo regarding possession shall be

maintained. However, if petitioner fails to submit explanation and documents within the aforesaid period, it is open for the 3rd respondent to take appropriate action in accordance with law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.
