wp_41388_2016 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for issue of Habeas Corpus by directing respondent No. 4 to produce Bosi Mercy (hereinafter referred to as 'the detenue'), D/o Bosi Appala Raju, before the Court. 2.

On 27-12-2016, the alleged detenue was produced by the police from the custody of respondent No. 4 who was also personally present. On the counseling of the Court, respondent No. 4, who is already married, has undertaken to file an affidavit to the effect that he will not trouble the alleged detenue and insist her on marrying him and he has also agreed to engage a counsel to appear on his behalf.

Today at the hearing, the alleged detenue and respondent No. 4 are present. The mother of the alleged detenue is also present. As undertaken, respondent No. 4 has filed an undertaking affidavit, wherein he has inter alia stated as under:

"I submit that the above Writ Petition has been filed for issuance of Writ of Habeas Corpus and the above Writ Petition came up for hearing on 27-122016 on which the detenue was produced and she agreed to go along with her parents and this Hon'ble Court directed me to give an undertaking that I will not interfere with the personal life and liberty of the detenue. I submit that I am working in Indian Army and I have old aged parents who are depended upon me and I hereby undertake that I will not interfere with the personal life and liberty of the detenue in any manner." Respondent No. 4 has also orally assured the Court that he will not interfere with the life of the alleged detenue.

Having regard to the undertaking affidavit given by respondent No. 4 and the fact that the alleged detenue has already joined her parents, the Writ Petition is closed.
