HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition Nos.5946, 6133 and 6299 of 2015 COMMON ORDER:
Heard the learned counsel appearing for the petitioners and the learned Government Pleader for Civil Supplies (TG).
2. The petitioners in the above three writ petitions are the proprietors of rice mills in Nizamabad District. The 2nd respondentCorporation has been supplying the stock of paddy under Custom Milling Rice Scheme since the years 2011-12. Likewise, for the crop year of 2014-15 also, the 2nd respondent-Corporation has supplied paddy stock to the rice mills of the petitioners. The proprietors of the rice mills supplied certain extent of rice as per the agreement but failed to supply the remaining quantity of rice within the time stipulated under the agreement. It is submitted by the learned counsel for the petitioners that there is shortage of power supply and scarcity of the workers in the District of Nizamabad and therefore, they could not supply the required rice within the stipulated period and they made representations to the 2nd respondent-Corporation to extend the time to deliver the rice up to 31.12.2015. The said representations are pending with the 2nd respondent.
3. Learned Government Pleader for the Civil Supplies submits that the petitioners have to deliver the rice by 31.12.2014, but they have not delivered the rice in time. Learned counsel appearing for the petitioners submits that the respondents have extended the time in good number of cases beyond the time stipulated and therefore, he seeks a direction to the respondents to extend the time.
4. Having regard to the submissions made on either side, the respondents are directed to consider the representations made by the petitioners seeking extension of time for delivery of rice and pass
appropriate orders on the said representations within a period of four weeks from the date of receipt of a copy of this order.
5. All the three writ petitions are accordingly disposed of. Pending miscellaneous petitions, if any, in these writ petitions, shall stand closed. No order as to costs.
