THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.20902 of 2018 ORDER:

The petitioner aggrieved by the continued inaction in numbering the appeal presented on 05.10.2017 under Section of the Land Encroachment Act 3 of 1905 against the order dated 11.09.2017 of Tahsildar, Anandapuram Mandal, Visakhapatnam District has filed the instant writ petition.

The appeal filed ought to have been numbered by the 3rd respondent within reasonable time. In the case on hand, since the delay from the date of filing till date is substantial, the writ petition is disposed of by directing the 3rd respondent to number the appeal filed on 05.10.2017 against order dated 11.09.2017 forthwith and directed to take up interlocutory application filed and pass orders as are deemed fit. The petitioner is given liberty to file a memo by enclosing copy of this order for due compliance of the direction by the 3rd respondent. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
